La función de los más capaces en una sociedad humana medianamente sana es cuidar y proteger a aquellos menos capaces, no aprovecharse de ellos.

Y a propósito del tema, sostengo firmemente que la Anglosfera debe ser destruida.

A una bancarrota, a una depresión, a una situación de inestabilidad tan extrema que el sistema social y económico hubieran de refundarse sobre un consenso generalizado que tendría, por esa necesidad de consenso, que incluir a unos sectores conservadores y fundamentalistas que cada vez están más lejos de la ideología americana dominante pero cuentan con un fuerte grado de cohesión interna, un valor añadido en una crisis.

Pero valdría cualquier revés lo bastante determinante como para arruinar la fuerza icónica de Obama en la sociedad americana futura. Tendemos a despreciar la importancia que le da el "nuevo americano medio" (multirracial, relativamente laico, barnizado de progre, pero tan ignorante como el antiguo) a ese factor.

El "mall" (centro comercial) americano, símbolo del "american way of life" por y para el consumismo de los años 80 y 90 está muriendo... (en realidad lo que está muriendo  -además de por la competencia del comercio online- es el modelo consumista, el exportar la inflación y que todas las manufacturas -la economía productiva- se hayan llevado a las maquiladoras del tercer mundo está devolviendo el golpe a la clase trabajadora de occidente -si se cargan los ingresos de la gente, no sé cómo coj... quieren que consuman, de todas formas, el modelo en que todo el trabajo de manufactura es deslocalizado a paises del tercer mundo para hacerse en condiciones de cuasiesclavitud y sin ningún tipo de respeto por el medioambiente mientras que en occidente todo se reduce a trabajos administrativos y de servicios y a consumir todo lo que se produce en china, descrito magistralmente en el libro "No Logo" de Naomi Klein, y además forzando un modelo de "usar y tirar" mediante la obsolescencia planificada no tiene ningún sentido -salvo para los que se forran con el proceso, claro- y tiene que reventar antes ó después....)

Recuerdo varios reportajes fotográficos del gran forero José Hinojosa Corbacho en el otro foro, sobre centros comerciales españoles que estaban cerrando, quedando desiertos y/o siendo abandonados...

America has too many malls.

I’ve recently blogged that many traditional brick-and-mortar retailers are being threatened with "economic destruction" by their advantaged online competition. In an interview with Bloomberg TV, anchorwoman Nicole Lapin asked about the implications of this dynamic on retail real estate. I said I hadn’t studied it, but I thought the ramifications would be very big and very negative (I believe the phrase "apocalyptic" was used).

I’ve since had the opportunity to spend some time looking at this issue, and I believe we’re seeing clear signs that the e-commerce revolution is seriously impacting commercial real estate. Online retailers are relentlessly gaining share in many retail categories, and offline players are fighting for progressively smaller pieces of the retail pie. A number of physical retailers have already succumbed to online competition including Circuit City, Borders, CompUSA, Tower Records and Blockbuster, and many others are showing signs of serious economic distress. These mall and shopping center stalwarts are closing stores by the thousands, and there are few large physical chains opening stores to take their place. Yet the quantity of commercial real estate targeting retail continues to grow, albeit slowly. Rapidly declining demand for real estate amid growing supply is a recipe for financial disaster.

I don’t think we’re overbuilt, I think we’re under-demolished.

There are very few thriving physical retailers these days outside of the daily consumables markets. I did a quick analysis on the high-level health of the National Retail Federation’s list of the Top 100 retailers in 2012, focusing on merchandise retailers that would likely be located in malls (removing grocery, drug, restaurant and online retailers). I looked at three measures of retailer health: total sales growth, comp store sales growth and number of stores.

The analysis doesn’t paint a very pretty picture regarding the health of the leading physical retailers in the United States. Total sales growth is mixed and is negative for 20 percent of the sample. Comp store sales growth—arguably the key measure of retailer health—is also mixed and a quarter of the sample is negative. And note that many of these sales results include the retailers’ online segments, so the picture for their physical stores is even worse. Lastly, store counts are simply stagnant—about as many top retailers shrank their store count as expanded it, and precious few are expanding aggressively. The largest retailers in the U.S. do not look very healthy. And if they’re struggling, it’s likely that their more marginal physical competitors are struggling even more.

I went back to the Top 100 retailers in 2007 to see how that crop had fared five years later and found that four of these top retailers had already gone away through Chapter 11. Interestingly, the picture of these four doesn’t look that different than the 2012 list.

This declining retailer health is directly impacting malls and shopping centers in the form of very high vacancy rates and sluggish rents—exactly what you’d expect to see where supply exceeds demand. Both factors deteriorated quickly during the economic crisis of 2008-09, but they’ve shown virtually no improvement since in spite of improved economic conditions. The recession was the catalyst, but competition from online retailers can only be the continued driver. The mall business isn’t very healthy either.

These trends are hitting the market capitalizations of most of the largest owners of retail real estate. Simon, General Growth, DDR and Kimco between them own over 600 MILLION square feet of U.S. retail real estate, according to nreionline. Simon’s stock has performed strongly, but the other three stocks have created virtually no value over the past decade.

Most real estate professionals understand that profound changes are afoot. Don Wood, CEO of Federal Realty Investment Trust, says "there is too much retail supply in this country." The Wall Street Journal reports:

    Green Street Advisor, an analysis firm that tracks REITs, has forecast that 10 percent of the roughly 1,000 large malls in the U.S. will fail within the next 10 years and be converted into something with far less retail. That’s a conservative estimate; many mall CEOs predict the attrition rate will be higher.

And Daniel Hurwitz, president and CEO of DDR, observes, "I don’t think we’re overbuilt, I think we’re under-demolished."

I agree with the above perspectives, although I believe they likely understate the eventual impact on malls. A report from Co-Star observes that there are more than 200 malls with over 250,000 square feet that have vacancy rates of 35 percent or higher, a "clear marker for shopping center distress." These malls are becoming ghost towns. They are not viable now and will only get less so as online continues to steal retail sales from brick-and-mortar stores. Continued bankruptcies among historic mall anchors will increase the pressure on these marginal malls, as will store closures from retailers working to optimize their business. Hundreds of malls will soon need to be repurposed or demolished. Strong malls will stay strong for a while, as retailers are willing to pay for traffic and customers from failed malls seek offline alternatives, but even they stand in the path of the shift of retail spending from offline to online.

This in turn creates further opportunity for online commerce. If I were thinking of starting a new retail brand right now, I would unquestionably start it online. And many very talented entrepreneurs are doing just this. I personally shop at Bonobos for pants, J.Hilburn for sweaters, Ledbury for shirts and Warby Parker for eyeglasses. All of these brands design and source their own goods. They historically would have started in the mall but they now are starting online, a trend that will undoubtedly continue. There clearly will be fewer new offline retailers to take the space vacated by the disappearing brick-and-mortar chains, further pressuring malls.

And in an ironic turn, many of these online brands are experimenting with offline stores—but typically with some important twists. Bonobos and Warby Parker have built showrooms in their New York offices where consumers can come in and try on samples. But if the consumer wants to purchase items, then the companies fulfill the product from their warehouses—they don’t stock inventory in their "stores."

Bonobos has expanded this concept into a few additional locations, but not mall locations. Instead, they are selecting lower cost, non-mall locations and using emails to their online customers to drive folks to these locations. They do this because a consumer’s purchasing typically expands after a visit to their physical store, and the costs are not high given the lack of inventory and lower rents and staffing costs. If this trend expands, it will provide further challenges to malls.

In researching this post, I came across a fascinating (and slightly morbid) website called deadmalls.com, a site that chronicles the tales of hundreds of already or soon-to-be dead malls. Co-founder Brian Florence writes:

    I started deadmalls.com with my friend Peter Blackbird in 2000 when we both realized that Pete had mountains of data about dead and dying malls stuck up in his head. Why keep this information to yourself? And, realizing the burgeoning power of the Internet and its ability to draw in more information, the site was created to harness stories of woe and merriment from others. It’s been a great success.

Unfortunately for mall owners, the content on deadmalls.com is about to expand substantially. There just are too many malls in America, and this will only get worse.

De megalópolis a jungla semiurbana, desde sus días de gloria automovilística, la ciudad de Detroit ha perdido el 63% de su población. El espacio geográfico sigue siendo el mismo: 359 kilómetros cuadrados que corren una suerte desigual. En algunos puntos, la naturaleza reclama lo que es suyo, y reforesta, salvaje, manzanas enteras. Hay en Detroit 800.000 estructuras vacías, la mayoría en estado ruinoso. Los esfuerzos de recuperación, privados y públicos, se concentran en algunas áreas reducidas, que se hacen atractivas para los residentes, afeando aún más los barrios depauperados.

Defense Bill: Obama Signs $633 Billion Measure Into Law


HONOLULU — President Barack Obama signed a $633 billion defense bill for next year despite serious concerns about the limits Congress imposed on his handling of terror suspects and lawmakers' unwillingness to back the cost-saving retirement of aging ships and aircraft.

Obama had threatened to veto the measure because of a number of concerns, but relented because he couldn't pick and choose specific sections. However, in a statement, the president spelled out his concerns about restrictions on his ability to carry out his constitutional duties as commander in chief.

Specifically, he complained that the bill limits the military's authority to transfer third-country nationals being held at a detention facility in Parwan, Afghanistan. He also took issue with restrictions on his authority to transfer terror suspects from the U.S. military prison at Guantanamo Bay, Cuba.

"Decisions regarding the disposition of detainees captured on foreign battlefields have traditionally been based upon the judgment of experienced military commanders and national security professionals without unwarranted interference by members of Congress," Obama wrote.

He said the section of the bill related to detainees in Afghanistan "threatens to upend that tradition, and could interfere with my ability as commander in chief to make time-sensitive determinations about the appropriate disposition of detainees in an active area of hostilities."

Obama promised when he took office four years ago to close the prison at Guantanamo, but congressional opposition from Republicans and some Democrats have prevented him from fulfilling that vow. The law limits his authority to transfer terror suspects to foreign countries or move them to the United States.

Obama insisted that he still believes that Guantanamo should be shuttered because operating the facility "weakens our national security by wasting resources, damaging our relationships with key allies and strengthening our enemies."

The president said his administration will interpret the bill's provisions and if they violate the constitutional separation of power, he will implement them in a way to avoid that conflict.

The law puts off the retirement of some ships and aircraft, and Obama warned that the move could force reductions in the overall size of the military as the Defense Department faces cuts in projected spending.

The law includes cuts in defense spending that the president and congressional Republicans agreed to in August 2011, along with the end of the war in Iraq and the drawdown of American forces in Afghanistan. And it would authorize $528 billion for the Defense Department's base budget, $17 billion for defense and nuclear programs in the Energy Department and $88.5 billion for the war in Afghanistan.

The measure is about $29 billion under the current level, largely due to smaller amounts for Iraq and Afghanistan.

The measure tightens penalties on Iran to thwart its nuclear ambitions and bulk up security at diplomatic missions worldwide after the deadly Sept. 11 raid in Libya.

La acuñación de una sola moneda de platino, por un billón de dólares, podría permitir al Gobierno de Estados Unidos conseguir un aumento del techo de endeudamiento, sin pasar por el Congreso, una triquiñuela inédita pero que cada vez más expertos en este país consideran viable.
El último en dar credibilidad a esta curiosa alternativa, para evitar la amenaza de la suspensión de pagos, fue esta semana Jerrold Nadler, congresista demócrata, para quien la idea "suena estúpida, pero es absolutamente legal".
"Cuando te chantajean con destruir la economía nacional, tienes que considerar alternativas", indicó el congresista, en referencia a la amenaza de la oposición republicana de no autorizar el aumento del techo de endeudamiento, si el Gobierno no introduce recortes drásticos en los gastos federales.
La vía normal para el presidente Barack Obama sería buscar un acuerdo con los republicanos, que tienen la mayoría en la Cámara de Representantes, para obtener la autorización del Congreso, algo que se presume muy complicado, sobre todo después de los enfrentamientos provocados por la crisis del llamado "precipicio fiscal".
La solución de la moneda de platino comenzó a circular por internet en 2011 y cada vez más economistas se apuntan a ella.
Según la ley, el Tesoro puede acuñar una moneda de platino y asignarle el valor que desee, algo que normalmente se limitaba a la producción de monedas para coleccionistas de valores relativamente bajos.
Ahora, lo que se propone es que el Tesoro acuñe una moneda, de un billón de dólares por ejemplo, la deposite en la Reserva Federal (el banco central de EEUU) y respalde con ella la capacidad de endeudarse por esa cantidad, suficiente para elevar virtualmente, de un golpe, el techo de la deuda nacional.
Estados Unidos superó el 31 de diciembre el límite autorizado de deuda (16,4 billones de dólares), pero gracias a la ingeniería contable el Tesoro puede retrasar un par de meses más la necesidad de aumentar ese techo y no declararse en suspensión de pagos.
El Tesoro no tiene la capacidad de imprimir dinero, algo que es potestad de la Reserva Federal, pero el recurso legal a la "moneda de platino", por caprichoso que parezca, podría evitar que se repitan los enconados debates en el Legislativo del verano de 2011, que condujeron a la pérdida de la triple A en la calificación de la deuda estadounidense por primera vez en la historia.
El Premio Nobel Paul Krugman trató esta "peculiar excepción" este miércoles como una posibilidad real, con el argumento de que "vivimos en un tiempo económico extraño, en el que las reglas normales ya no cuentan".
La Casa Blanca publicó que había recibido una petición ciudadana para que se cree una moneda de platino de un billón de dólares, petición que ya ha reunido casi 3.000 firmas de las 25.000 necesarias para que el Ejecutivo tenga que pronunciarse al respecto.
La justificación de los peticionarios es que la opción de la moneda del billón de dólares "no es más absurda que la de jugar al fútbol político con la economía estadounidense y la del mundo entero".
Los problemas residen en el peligro que entraña crear un precedente saltándose todos los procedimientos ordinarios, además de los efectos imprevisibles sobre la inflación de esta "impresión" indirecta de dinero, aunque muchos economistas no lo consideran un riesgo.
La alternativa es que el presidente Barack Obama invoque la Decimocuarta Enmienda de la Constitución que permite al mandatario utilizar su poder ejecutivo para que "la validez de la deuda pública de Estados Unidos no sea cuestionada".
La Casa Blanca ha reiterado que no contempla recurrir a esta opción constitucional, aunque algunos medios estadounidenses no la descartan del todo si las negociaciones con los republicanos, que piden recortes a cambio de un acuerdo sobre la deuda, vuelve a estancarse.

La acuñación de una sola moneda de platino, por un billón de dólares, podría permitir al Gobierno de Estados Unidos conseguir un aumento del techo de endeudamiento, sin pasar por el Congreso, una triquiñuela inédita pero que cada vez más expertos en este país consideran viable.
El último en dar credibilidad a esta curiosa alternativa, para evitar la amenaza de la suspensión de pagos, fue esta semana Jerrold Nadler, congresista demócrata, para quien la idea "suena estúpida, pero es absolutamente legal".
"Cuando te chantajean con destruir la economía nacional, tienes que considerar alternativas", indicó el congresista, en referencia a la amenaza de la oposición republicana de no autorizar el aumento del techo de endeudamiento, si el Gobierno no introduce recortes drásticos en los gastos federales.
La vía normal para el presidente Barack Obama sería buscar un acuerdo con los republicanos, que tienen la mayoría en la Cámara de Representantes, para obtener la autorización del Congreso, algo que se presume muy complicado, sobre todo después de los enfrentamientos provocados por la crisis del llamado "precipicio fiscal".
La solución de la moneda de platino comenzó a circular por internet en 2011 y cada vez más economistas se apuntan a ella.
Según la ley, el Tesoro puede acuñar una moneda de platino y asignarle el valor que desee, algo que normalmente se limitaba a la producción de monedas para coleccionistas de valores relativamente bajos.
Ahora, lo que se propone es que el Tesoro acuñe una moneda, de un billón de dólares por ejemplo, la deposite en la Reserva Federal (el banco central de EEUU) y respalde con ella la capacidad de endeudarse por esa cantidad, suficiente para elevar virtualmente, de un golpe, el techo de la deuda nacional.
Estados Unidos superó el 31 de diciembre el límite autorizado de deuda (16,4 billones de dólares), pero gracias a la ingeniería contable el Tesoro puede retrasar un par de meses más la necesidad de aumentar ese techo y no declararse en suspensión de pagos.
El Tesoro no tiene la capacidad de imprimir dinero, algo que es potestad de la Reserva Federal, pero el recurso legal a la "moneda de platino", por caprichoso que parezca, podría evitar que se repitan los enconados debates en el Legislativo del verano de 2011, que condujeron a la pérdida de la triple A en la calificación de la deuda estadounidense por primera vez en la historia.
El Premio Nobel Paul Krugman trató esta "peculiar excepción" este miércoles como una posibilidad real, con el argumento de que "vivimos en un tiempo económico extraño, en el que las reglas normales ya no cuentan".
La Casa Blanca publicó que había recibido una petición ciudadana para que se cree una moneda de platino de un billón de dólares, petición que ya ha reunido casi 3.000 firmas de las 25.000 necesarias para que el Ejecutivo tenga que pronunciarse al respecto.
La justificación de los peticionarios es que la opción de la moneda del billón de dólares "no es más absurda que la de jugar al fútbol político con la economía estadounidense y la del mundo entero".
Los problemas residen en el peligro que entraña crear un precedente saltándose todos los procedimientos ordinarios, además de los efectos imprevisibles sobre la inflación de esta "impresión" indirecta de dinero, aunque muchos economistas no lo consideran un riesgo.
La alternativa es que el presidente Barack Obama invoque la Decimocuarta Enmienda de la Constitución que permite al mandatario utilizar su poder ejecutivo para que "la validez de la deuda pública de Estados Unidos no sea cuestionada".
La Casa Blanca ha reiterado que no contempla recurrir a esta opción constitucional, aunque algunos medios estadounidenses no la descartan del todo si las negociaciones con los republicanos, que piden recortes a cambio de un acuerdo sobre la deuda, vuelve a estancarse.

However, as that petition promptly accumulated well over 34,000 signatures, the White House had no choice but to respond. The Administration shares your desire for job creation and a strong national defense, but a Death Star isn't on the horizon. Here are a few reasons:

- The construction of the Death Star has been estimated to cost more than $850,000,000,000,000,000. We're working hard to reduce the deficit, not expand it.  :biggrin: ¿Seguro?

- Why would we spend countless taxpayer dollars on a Death Star with a fundamental flaw that can be exploited by a one-man starship?

However, look carefully (here's how) and you'll notice something already floating in the sky -- that's no Moon, it's a Space Station! Yes, we already have a giant, football field-sized International Space Station in orbit around the Earth that's helping us learn how humans can live and thrive in space for long durations. The Space Station has six astronauts -- American, Russian, and Canadian -- living in it right now, conducting research, learning how to live and work in space over long periods of time, routinely welcoming visiting spacecraft and repairing onboard garbage mashers, etc. We've also got two robot science labs -- one wielding a laser -- roving around Mars, looking at whether life ever existed on the Red Planet.

Keep in mind, space is no longer just government-only. Private American companies, through NASA's Commercial Crew and Cargo Program Office (C3PO), are ferrying cargo -- and soon, crew -- to space for NASA, and are pursuing human missions to the Moon this decade.

We are discovering hundreds of new planets in other star systems and building a much more powerful successor to the Hubble Space Telescope that will see back to the early days of the universe.

We don't have a Death Star, but we do have floating robot assistants on the Space Station, a President who knows his way around a light saber and advanced (marshmallow) cannon, and the Defense Advanced Research Projects Agency, which is supporting research on building Luke's arm, floating droids, and quadruped walkers.

We are living in the future! Enjoy it. Or better yet, help build it by pursuing a career in a science, technology, engineering or math-related field. The President has held the first-ever White House science fairs and Astronomy Night on the South Lawn because he knows these domains are critical to our country's future, and to ensuring the United States continues leading the world in doing big things.

If you do pursue a career in a science, technology, engineering or math-related field, the Force will be with us! Remember, the Death Star's power to destroy a planet, or even a whole star system, is insignificant next to the power of the Force.

Orador conservador afín al G.O.P. advierte a sus correligionarios republicanos: sean cristianos si quieren, pero si no dejan de identificar al partido tan decantadamente con el cristianismo evangélico del Sur, perderán por completo a minorías que, si no fuera por eso, tendrían mucha afinidad ideológica y económica con el Partido Republicano. Por ejemplo, los asiáticos.

Y, con la demografía en la mano, si no logran captar esos sectores de población, los electores republicanos pueden no volver a nombrar un Presidente de los EE.UU.

El problema que tiene EE.UU. con las religiones es mucho, pero mucho más gordo que el que tiene la UE con los idiomas. Por lo menos en el problema de los idiomas hay soluciones concretas.

¿Por qué los comparo? Porque me parece mucho más obstáculo para llegar a un acuerdo que el no hablar el mismo idioma, obstáculo además de una aleatoriedad total y sin transigencia posible en las mentes de quienes están implicados.

El GOP tiene lios graves desde que en los 70 decidió incorporar la extrema derecha (white trash, tea party, anti aborto y demás) Para arreglar el tema llegaron los neocons. Tiene que ver esa masa con el conservadurismo europeo lo que yo con el Emperador de la China.
Recomiendo este link. Los neocons y el lobby de Israel se lo van a poner difícil al nuevo Secretario de Defensa, Chuck Hagel.

Viaje al futuro del imperio es una excelente obra de Kaplan, que emplea los paisajes costumbristas para desarrollar un ensayo sobre los Estados Unidos del siglo XXI. De todos modos la situación actual norteamericana tiene un componente de cataclismo económico que no se hasta que punto podrán las intuiciones de Kaplan hacerse realidad, o ir un punto más allá, con la tan nombrada en este foro disgregación estadounidense.

De todas formas, de Kaplan hay otras obras excelentes, "El retorno de la Antigüedad" entre ellas.
La función de los más capaces en una sociedad humana medianamente sana es cuidar y proteger a aquellos menos capaces, no aprovecharse de ellos.

Y a propósito del tema, sostengo firmemente que la Anglosfera debe ser destruida.

Ligeramente off-topic. La historia de un gestor de inversiones investigando Herbalife (marketing multinivel que existe desde hace años en España) y lo que revela de las relaciones económicas a nivel local (micro), la corrupción de los directivos (consejero delegado), social (grupos desfavorecidos y explotación) y cultural (hispanos vs anglosajones).

I visited a Herbalife nutrition club in Queens. There is plenty wrong with this company – but this is not a post about the things that are wrong with the company (most of those I will leave for other people to think about). This is simply a post about what I observed and the implications for Bill Ackman's Herbalife thesis.
 
 (a). There are a lot of Herbalife nutrition clubs in Queens. This is an Hispanic area and within the US Herbalife is mainly an Hispanic phenomenon. If you use Google satellite navigation on your phone you will find lots Herbalife clubs (dozens are listed around Corona Queens) though some of the ones you try to locate will not be there any more (suggesting they have either moved or closed).
 
 (b). I was told the best time to visit a nutrition club was between 7 AM and 9 AM so I dutifully arrived at about 7.15. The club was empty. I was told to go with a Spanish speaker because the clubs were pretty close to mono-lingual Spanish. The club was not signposted from the street and coloured paper made opaque the windows so a passer by would not know what was in there.
 
 (c). I was served “all three” meaning an aloe drink, a diet suppressing tea and the protein shake.
 
 (d). This was the first time I had drunk a protein shake. I can tell you they suck - so does the tea for that matter. This stuff tastes unbelievably bad. It is flat-out-gross. I sent an email (with the trusty smart-phone) to a friend in Asia explaining where I was and told him how gross it was. He puzzled: he asked if I was a virgin. He explained that when he was a competitive lightweight rower (he rowed for an Ivy League university) he used to live on protein shakes as he had to keep his weight within the limits. And he exercised extensively on them. Exercise and protein shakes is a well-worn and proven weight loss combination. But they do taste gross. [I have been informed that Herbalife taste slightly better than some protein shakes at the cost of adding some sugars – also I have been informed the texture is much improved by blending in a banana or even a mango....]
 
 (e). There were no visitors prior to 8 AM. By 8 AM I was going to sell my entire Herbalife long and give up on the position. My Spanish translator talked to the guy running the place and he told us roughly how many visitors he got a day and told us the time they came in – and that it really started by about 8 AM.
 
 (f). The translator was correct. The visitors started around 8 and in the next 75 minutes over twenty came in. They came in roughly to his schedule suggesting that they were regulars. They spoke in Spanish and he spoke to them as friends. Most of them were either no longer obese or in the transition from being morbidly obese to (merely) rectangular shaped.
 
 (j). The key product: the proprietor/distributor greeted the visitors as friends and offered moral support as they drank the tea and the shake.
 
 (k). There was a series of before and after photos on the wall. They were impressive – many of the customers – and the husband and wife team that ran the club – had gone from balloon shaped to roughly rectangular. [I gather before and after photos are impressive at other weight-loss groups such as Weight Watchers - however in this case there were a lot of impressive photos for a very small club.]
 
 (l). The husband and wife who ran the shop had been Herbalife customers for about five and a half years and had been running the club for about eighteen months. They were true believers in the product – extolling its virtues and also repeating mostly in Spanish but also in Spanglish the benefits of the Herbalife system. [In their case they also also extolled the virtue of replacing the fat-and-cheeze laden meals that were non Herbalife with something more nutritious and the virtue of some exercise even if it was just walking further.]
 
 (k). The benefits of the Herbalife program in the wife's case were real. The wife had gone from a three insulin shot per day diabetic to a half insulin shot per day diabetic. [Statistically this should add over 15 years to her life expectancy.] Her prior body was balloon shaped.
 
 (l). On the wall was a list of the seventy odd people who regularly attend this Herbalife club. There was a list of gold stars against the names with weight-loss and Herbalife consumption targets on them. Clearly the gold stars were part of the reward system. This looked a little like primary school.
 
 (m). We asked if he had any “downline”. He explained to us that every one of his core customers was also a distributor – and they were a distributor to get the 25 percent discount on stuff they took home.
 
 Observations
 
 This club was not a club selling diet drinks (but it clearly did that). It was a club selling the social support group necessary to drink diet drinks. These diet drinks work (especially when combined with a modicum of exercise). What happens though is that normal people do not have the will-power to maintain a diet drink and exercise regime. My friend in Singapore did – but then he rowed competitively and people into rowing are austere driven people (think all those 4 AM starts).
 
 But I am a fairly disciplined person and - without social support I could not drink these shakes.
 
 In the richer-parts of our society we have a solution to diet-and-exercise will-power problem. We hire a personal trainer (usually someone cheerful, younger and good looking) and they cajole us into weight-loss. This is a “for-hire” personal support group.
 
 But Herbalife is another valid mechanism of getting personal support – and it clearly worked on the customers I saw. Personally I find it very difficult not to endorse a product that reduced to one sixth a person's insulin injection requirement. If Bill Ackman thinks America would be better off without Herbalife he could politely explain that at the woman's funeral.
 
 I will - in the interest of fairness - include the main negative observation: the man who ran this shop covered his rent (we worked that out) but he was cheerful man working hard (80 plus hours a week) and making an amount that was less than minimum wage. I gather than many (possibly a majority) of Herbalife clubs do not cover rent (consistent with the observation that there are lot of Herbalife clubs in Google maps that no longer seem to exist). Minimum wage appears to be the upside.
 
 This showed both the benefit and problems with multi-level marketing. The benefit is that it allows a company (in this case Herbalife) to get deep into a community and that is a necessary part of the product – the product they are selling is community support for weight loss and they can't do that without getting into the community. The problem is that the company actively recruits distributors to the point that it is impossible for the distributors to be good businesses. Indeed as the rewards to many people in the chain are on recruitment (and you can't make it up the chain without a substantial “down-line”) it is likely that recruitment will continue until the distributors make nothing (or less than nothing when convinced to sign up by hard-sell rather than rational argument).
 
 There were so many Herbalife clubs around Queens that I suspect on average the Herbalife shops make something near nothing or less than nothing. The profile of a Ferrari driving Herbalife distributor that Mr Ackman presented was – at least compared to what I saw – ludicrous.
 
 I wrote once about income distribution in the US by working out how cheap my laundry was in Brooklyn and working out that it was being done in a sweat-shop with illegal Chinese workers paid under minimum wage. [I got a lot of flack for that post from my libertarian readers.] The Herbalife distributor I met (who may also have been an illegal) had a better life than those illegal sweat-shop workers. He did not earn much more money – but his job was community based and he interacted as a friend with a great many customers. That I think was personally satisfying and he clearly was happy with his lot. And the product saved his wife's life which trumps most things.
 
 Herbalife as exploitative in a Marxist sense
 
 Herbalife is clearly an exploitative system in the Marxist sense.
The head-honcho is paid well over $70 million derived from a vast network of people earning minimum wage or less. Dan Loeb (who now controls 8 percent of Herbalife) is someone who often attacks excessive salaries for senior executives. This could become quite amusing.
 
 Some comments on Bill Ackman's thesis
 
 It was striking how totally Bill Ackman's thesis fell apart from observing for just a few hours in a nutrition club.
 
 The best way of analysing Herbalife that I can find is as alcoholics anonymous for fat (and very often Hispanic) people. I joke: “my name is Jose and I am fat”.
 
 Herbalife works in the same way as alcoholics anonymous – by supplying (and in this case selling) a support group to help you kick the “fat addiction”.
 
 Like Alcoholics Anonymous it has millions of members and looks – at least externally – a bit like a cult.
 
 Herbalife like Alcoholics Anonymous has millions of members because it works. It does not work because one nutrition powder is better than another (indeed some nutritionists argue soy based powders are inferior). Herbalife works because of the support group.
 
 AA is probably the single most effective way devised by humanity to cure alcoholics. It is far more effective than any drug developed by pharmaceutical companies and if a drug were devised as effective as and as free of side effects as AA then it would be worth tens of billions of dollars. Even then AA probably fails a majority of times. Herbalife is among the more successful ways of curing morbid obesity (but even then it probably fails a majority of times). [I shudder to think what a weight-loss drug as effective as the Herbalife support system would be worth though - considerably more than Herbalife's market cap.]
 
 The biggest difference that I can see between AA and Herbalife is that Herbalife is (emphatically) a for-profit institution (and possibly quite an exploitative for profit institution) whereas AA is just a club.
 
 Lets run through Ackman's presentation by section
 
 Ackman on Herbalife as a commodity
 
 From Page 21 to 26 of the presentation Bill Ackman “demonstrates” that Herbalife's products are not unique – and from that he argues that they do not maintain their price position by being a “proprietary product”. He compares the product to GNC and other brands and notes the price per serve or the price per calorie is higher.
 
 This is a complete misunderstanding of Herbalife's product. GNC and other brands are sold as commodities. Herbalife is sold with a community support mechanism.
 
 In Central Park anyone can go and have a run. It is free. It costs you $20 an hour if you exercise with a personal trainer. Comparing the price of Herbalife (sold through a network) to the GNC (sold without a network) is like comparing the cost of a run through the park without and with a personal trainer.
 
 Bill Ackman has just missed the point.
 
 Ackman on Herbalife's lack of advertising
 
 From pages 27 to 31 Bill Ackman notes the lack of advertising expense on Herbalife (which he argues is very little) and says that they cannot maintain their price premium that way.
 
 This is of course garbage. Herbalife has the best advertising possible – word of mouth. People will pay huge sums to Facebook for the hope of getting someone to “like” a product online and hence endorse it to their friends. Herbalife has far more powerful advertising support than that – it is deep in the community.
 
 Alcoholics Anonymous has 2 million members and I have never seen an advertisement for the product. However like you I have heard of AA. Brand recognition for community based products is (naturally) very high. I suspect almost every reader of my blog has heard of Alcoholics Anonymous without ever seeing an advertisement.
 
 That said Herbalife does sponsor one of the biggest football teams in the world (Barcelona). It also sponors LA Galaxy but nobody cares about them!
 
 Bill Ackman on Herbalife's research and development
 
 From page 35 to 50 Bill Ackman tells us all about Herbalife's (very thin) research and development program.
 
 He is of course right that relative to its claims Herbalife has a very thin research and development program. So what: Alcoholics Anonymous – relevant to its claims – has a very thin research and development program. And yet it is known to work for a lot of people and the results are well known.
 
 There is plenty of research that says social cues are important in whether you take drugs or not, whether you drink. And social cues are important as to whether you stay fat or not.
 
 You don't need a lot of research to tell you that.
 
 As Bob Dylan says: you don't need a weatherman to tell which way the wind blows.
 
 The main Bill Ackman mistake
 
 Page 164 of the Bill Ackman presentation lays out the key criteria for determining whether Herbalife is illegal. Here is the slide:
 
 

 
 I will quote this as it is the core criteria for determining whether Bill Ackman is right:
 
 <blockquote> The critical question for the FTC is whether the revenues that primarily support the commissions paid to all participants are generated from purchases of goods and services that are not simply incidental to the purchase of the right to participate in a money-making venture.</blockquote> Bill Ackman spends most of his presentation arguing that Herbalife's product is the business opportunity. He argues for instance that most the product is sold to "distributors". This was clearly true in the Herbalife club I visited. Almost every customer was also a distributor. They however were clearly customers - they came in - they paid their money - they drank their shake. They look like customers because they were customers.
 
 Bill Ackman calls these distributors victims of a false "business opportunity". Facts on the ground: they are customers.
 
 That fact is very inconvenient for Bill Ackman because if they are customers then Herbalife is legal and Ackman's thesis falls apart totally.
 
 Bill Ackman's logic as to why these distributors could not be customers is disarmingly simple - and amazingly erroneous. Bill Ackman argued that it was illogical for someone to sign up as Herbalife distributor for the 25 percent discount because even with a 25 percent discount the product was more expensive than commodity product available from GNC and other suppliers. [My Spanish translator came back to me with an errata on this point: he says that some of his downstream were considering the business opportunity - but the majority were distributors without any plans at all on the business opportunity.]
 
 That is true. But it misses the point.
 
 Remember those gold stars and the support group. If you buy weight loss shakes from GNC you do not get the gold stars. Buy the product from GNC and you are not part of this Latino self-help group. By not understanding Herbalife as a social support group for weight loss and by analysing the product as a commodity Bill Ackman has failed to observe what globally would add up to millions of customers. Real customers. The customers that make Herbalife legal.
 
 What this story is really about
 
 Herbalife is a company which combines a lot of good (think the life-saved diabetic above) with some pretty ugly features.
 
 But this is not really a story about Herbalife - Herbalife will survive globally. Like all multi-level marketing schemes it will have its ups and downs. There will be all sorts of problems (such as tax compliance throughout the scheme, cash handling, perhaps even using Herbalife accounts to launder money).
 
 What this has (deservedly) become is the story about how Bill Ackman can be so wrong. He spent (by his own admission) a year and a half analysing this company and his thesis can be falsified by visiting a few clubs in his home city. Bill Ackman's thesis is the most easily falsified bear-thesis I have seen from a major hedge fund ever.
 
 You have to wonder how this happened. So I am going to tell you:
 
 Bill Ackman a Harvard educated (magna cum laude) billionaire New York hedge fund manager bet over a billion dollars on a short position (imperilling his fund and his reputation) without checking the facts.
 
 And he did not check the facts because he was so rigid with a misplaced silver spoon that he could not stoop to sit on a subway for thirty minutes and talk with poor people for ninety minutes

Yo no veo la ruptura de los EEUU en el horizonte. En el fondo el gran activo de ese país es su sólida tradición institucional que ha dado lugar a un refinamiento que al menos en la parte de los "checks and balances" es ejemplar, posiblemente el líder mundial junto a Suiza, que lo ha resuelto de otro modo también interesante. Están los lobbies que todo lo han pervertido, el excesivo peso de lo militar y tantas cosas, pero la arquitectura institucional es para tratar de copiarla en muchos aspectos. Puede que tienda a confederarse pero quizá ni eso, la cosa es desactivar esas fuerzas disgregadoras que con los monstruosos aparatos que controlan agencias como la enorme y poco conocida NSA, no parece difícil.

En Portugal dicen que 1/3 de la población querría integrarse en España, lo que no se suele contar es que entre los 2/3 restantes hay desde indiferentes o vagamente opuestos a no pocos que si tuvieran cerca un español y un cuchillo mejor no pensar en lo que harían. Que en USA aparezcan pequeños grupos (cualquier estado del Midwest tiene la población de la C.Valenciana, o al menos la de Galicia tirando por lo bajo) de propósito secesionista seguro que está en la agenda de la NSA y de los lobbies mediáticos tradicionales o de internet. Aquí oímos Tennessee o Wisconsin y pensamos en cuatro paletos con su ganado, pero tienen más o menos la población de la C. de Madrid y enormes corporaciones con sede en sus capitales económicas (en cualquier "estaducho" hay sedes que ya las querríamos en España) cuyo mayor interés es precisamente mantener el primer activo de los EEUU que es un mercado único de 315M de personas con alta movilidad de capital y fuerza laboral.

Al final todo nos conduce al pésimo manejo que han hecho los líderes republicanos de su propaganda y sus asociaciones, y ligado a ello está el peligro de fomentar y dar visibilidad (seguramente subvencionar por mil vías, el sector público en USA tampoco es que sea mucho más pequeño que los euroepos) al fanatismo religioso más ridículo y retrógrado que se puede encontrar hoy fuera del mundo musulmán. El problema de fondo es que la "white trash" sureña y del medio Oeste que ha cooptado el GOP no debería ser parte de su clientela electoral, y han sido malas decisiones estratégicas cuando no pura desesperación las que han conducido a la actual estructura del partido, que es un inestable híbrido de defensores de la plutocracia y predicadores aldeanos y ha ido progresivamente abandonando a las capas medias conservadoras o liberales a las que solamente mantiene en cierta cantidad por ausencia de alternativa.
