Swiss President Wants Tax Accord From U.S.

BERN, Switzerland — In the view of Switzerland’s president, her country would sign a deal on banking secrecy with the United States “tomorrow” if not for an impasse created by Washington.

“We are ready,” President Eveline Widmer-Schlumpf, who is also finance minister, said here on Wednesday. “We’ve made a lot of constructive proposals. We could sign it tomorrow if the United States wants to do it.”

Relations between the United States and Switzerland have been troubled by the question of tax evasion since 2008, when American authorities began pursuing UBS, the largest Swiss bank, for helping thousands hide money from the Internal Revenue Service. UBS later settled with the Justice Department, turning over details of 4,450 client accounts and paying a fine of $780 million in exchange for a deferred prosecution agreement.

With their financial sector under global scrutiny, Swiss officials have been working to reach an agreement with Washington that would allow them to retain something of their 1934 banking law, which makes the disclosure of client identities a crime.

But American authorities have shown little interest in compromise, the Swiss say, and are pursuing criminal investigations of 11 Swiss banks, including Credit Suisse, the second largest.

In a sign of the tough approach Washington is taking, prosecutors in February indicted Wegelin & Company, the oldest Swiss private bank, on charges that it had helped Americans evade $1.2 billion in taxes. That prompted the bank, founded in 1741, to say it was breaking up, raising fears among the Swiss that Washington might pick off others.

The Swiss presidency rotates among the seven members of the country’s executive body, the Federal Council, with a different member serving each year. That makes Ms. Widmer-Schlumpf, 55 and a lawyer by training, “first among equals” on the council and the face of Switzerland in many international settings.

“We were very surprised by the Wegelin indictment,” Ms. Widmer-Schlumpf said, “because we understood there to be an implicit agreement that they would not do something like that during the negotiations.”

She said the countries had made “considerable progress” toward a global deal in the last few months. An agreement will include deferred prosecution deals against Swiss banks accused of helping American tax evaders, fines and a “substantial” transfer of client data to the Internal Revenue Service, she said.

Ms. Widmer-Schlumpf said that Switzerland, which accounts for more than one-quarter of the world’s offshore wealth, was not prepared to abandon banking secrecy altogether and that the data transfer “has to take place within the existing legal procedures in both countries.”

“States have rights, and we have to respect that,” she said, expressing hope that a deal would be reached soon. “I think it’s in the interest of both sides to come to a solution now.”

Ms. Widmer-Schlumpf spoke after the Swiss Parliament on Monday approved a new double-taxation treaty with the United States, under which American authorities will be able to more easily track suspected tax cheats, even without naming names, by asking for information on particular types of suspicious accounts.

Donald S. Beyer Jr., the American ambassador to Switzerland, told Swiss radio this week that it was a “positive and useful step.”

Paul L. Behling, a partner at the law firm Withers Bergman in New Haven, said that the Swiss Parliament’s approval “eliminates the legal obstacle to a deal” between the banks and the I.R.S.

Switzerland’s banking secrecy law has complicated banks’ efforts to resolve the conflict. Another source of friction is the distinction made by the Swiss, and virtually no one else, between tax fraud, a crime here, and tax evasion, which is not.

On the side of the United States, ratification of the double-taxation treaty, signed by the two governments in September 2009, has stalled. Senator Rand Paul, Republican of Kentucky, has balked at the treaty, arguing that it gives the I.R.S. too much power to intrude without grounds for suspicion of financial crimes.

Mr. Paul’s office did not respond to requests for comment. The Treasury and State Departments declined to comment.

“We have a very good relationship with the U.S.A.,” Ms. Widmer-Schlumpf said, noting, for example, that Switzerland represents American interests in Iran and is one of America’s largest investors.

“The problem we have now, you shouldn’t hang the whole relationship on it,” she added. “I believe that’s why we can find a solution to this problem.”

Ms. Widmer-Schlumpf said that Switzerland was working to improve its reputation with a “clean-money strategy” announced in February. The strategy is based on three main elements: new international withholding tax agreements with other countries, improved administrative assistance in international tax cases, and a requirement that Swiss banks scrutinize accounts more closely.

First, she said, the Swiss have to overcome their past sins, settling with the Americans and other governments and persuading doubters of their sincerity.

“Our problem is that we have not been taken seriously,” she said, though for several years “we’ve been doing more than other countries.” That includes efforts to fight money laundering and insider trading, more than 40 double-taxation agreements with other countries, and the adoption of tough capital standards at too-big-to-fail institutions like Credit Suisse and UBS.

Ms. Widmer-Schlumpf said the Swiss financial sector — which contributes about 11 percent of the country’s gross domestic product and accounts for about 200,000 jobs in a country of fewer than eight million people — might struggle in the first few years of a more transparent era.

“But in the long term,” she said, “we’ll gain clients because of the Swiss quality.”

A deal with the United States may not be the model for others, as the United States has a stick — the threat of denying Swiss banks access to its vast markets — that others lack. The Swiss-preferred models are the withholding tax deals reached last year with Britain and Germany, which will ensure that taxes are paid without divulging client data.

But those deals have been challenged by the European Commission because, the commission argues, they undermine its efforts to set up deals for automatic information exchange with Switzerland, which does not belong to the European Union. The German Parliament is also threatening to block any bilateral agreement on fairness grounds.

In any case, the writing is on the wall for American tax cheats in Switzerland. Some Swiss banks have been warning American clients that they should either prove they are in compliance with American law or have their accounts closed. They are also recommending that any clients not in compliance should hire a lawyer and enter the I.R.S.’s voluntary disclosure program.

“I tell my clients if they have an undeclared offshore account that it’s in their best interest to come back into compliance,” said Kevin E. Thorn, a tax lawyer in Washington who has helped people navigate the voluntary disclosure program. In practice, he said, that means paying a penalty, now 27.5 percent of the value of the undeclared account, and bringing their records up to date.

“Because if they don’t, and the government opens a criminal investigation, they’re going to pay a lot more,” he said, perhaps 50 percent or more of the undeclared account with the cost of fighting a felony charge of tax evasion to boot.

Martin Naville, chief executive of the Swiss-American Chamber of Commerce in Zurich, said the hope for Switzerland was that after a deal was reached, “there will still be some kind of confidentiality or data protection.”

“But protection for tax evaders, I think that part is really gone,” he added.

Mr. Naville said he was skeptical that a Swiss deal would do much to stop Americans from trying to beat the taxman.

“They’ll go to the Channel Islands; they’ll go to Singapore,” he said. “But no Swiss bank will touch them.”

(Reuters) - The chairman of Swiss private bank Julius Baer will head a special committee dealing with a U.S. tax probe after leaving his current role, underlining the pressure Swiss banks are feeling from claims they helped wealthy Americans dodge taxes.

Raymond Baer, a 52-year-old member of the bank's founding family who has been at the group almost 25 years and served as chairman for nine, will become honorary chairman of the bank as of its next shareholder meeting in April.

As part that new role, he has been elected to chair a special committee overseeing cooperation with U.S. authorities, the bank said on Monday.

Julius Baer (BAER.VX) is among 11 banks - including Credit Suisse (CSGN.VX) - under investigation by the U.S. Department of Justice. The indictment of Swiss private bank Wegelin in February has heightened tension among private bankers fearful of being next in the firing line.

In February, Julius Baer said it expected to have to hand over client data and to pay a fine as part of the U.S. probe into wealthy Americans who stashed their money in Swiss banks to avoid paying taxes.

"Raymond J. Baer will continue to support the Bank in finding constructive solutions for the past chapters affecting Julius Baer and the banking industry at large," the bank said.

A spokesman said Baer's departure from the chairman's role had been planned for some time, and was not related to his role on the special committee.

The spokesman said the committee was formed when the U.S. issues first surfaced. He added the committee would also deal with the bank's other legacy tax issues in Europe.

Last April, Baer said it had agreed to pay the German tax authorities 50 million euros to close a tax probe.

BAER'S METAMORPHOSIS

"This marks the exit of the last family member from official top positions within the bank and continues the process of turning Julius Baer from a family-run bank to a 'normal' quoted company," said Kepler analyst Dirk Becker.

"We stick to our 'Hold' rating on the stock as we believe its multiples are too high and the bank might face an expensive settlement with the U.S. about the cross-border tax settlement."

Baer shares were down 1.7 percent at 36.88 francs by 0911 GMT, lagged a 0.9 percent weaker European banking index .SX7P.

The bank was established by Julius Baer in 1890 and went public in 1980. The Baer family gave up the majority of its voting rights in 2005 when the bank launched a major expansion. The family's stake is now under 3 percent.

"The metamorphosis to turn our company from family business into a public company in all aspects is concluded," Raymond Baer, who is the last member of the founding family involved in the bank's management, said in a statement.

"Julius Baer has remained small enough to care, but big enough to matter, and retains a deeply entrenched family culture," added Baer, who headed the group's private banking business for ten years before becoming chairman.

The board nominated Daniel Sauter, a veteran of commodities trader Glencore (GLEN.L) and mining company Xstrata (XTA.L) and a board member since 2007, to take over as chairman.

A bank spokesman said the Baer family was not looking to reduce its stake in the bank.

Bern, 13.04.2012 - Today in Bern, President Eveline Widmer-Schlumpf and Austria's Federal Minister of Finance, Maria Fekter, signed a withholding tax agreement. It follows the same model as the Swiss tax agreement with Germany and the United Kingdom. Under this agreement, persons resident in Austria can retrospectively tax their existing banking relationships in Switzerland either by making a one-off tax payment or by disclosing their accounts. Future investment income of Austrian bank clients in Switzerland will be subject to a withholding tax, and the proceeds of this will be transferred anonymously to the Austrian authorities by Switzerland. In addition, mutual market access for financial services will be improved. The agreement requires the approval of parliament in both countries, and should enter into force at the start of 2013.

For President Eveline Widmer-Schlumpf, the conclusion of the agreement with Austria is yet another indication that Switzerland is serious about its new financial centre strategy. This creates legal certainty and should strengthen the competitiveness and reputation of Switzerland's financial centre in the long term. Switzerland does not want any further untaxed assets in the future.

The tax agreement between Switzerland and Austria corresponds largely to the agreements with Germany and the United Kingdom. There are differences concerning the applicable tax rates. The rate for the flat-rate one-off payment for regularising the past is between 15% and 38% depending on the duration of the banking relationship and the amount of assets concerned. A single rate of 25% applies for the taxation of future investment income. This corresponds to Austria's capital gains tax.

No advance payment by Swiss banks has been agreed. The inclusion of inheritance was superfluous given that Austria does not have inheritance tax. Moreover, as both contracting parties consider the existing administrative assistance procedure sufficient, no additional enquiry possibilities have been agreed.

Switzerland and Austria have also agreed to eliminate important obstacles for cross-border financial services and ease the conditions for banking licences in Austria. The distribution of securities funds will be simplified.

The agreement represents a good result, as it satisfies the interests and requirements of both countries equally well. The tax agreement signed by Switzerland and Austria not only respects the protection of bank clients' privacy applicable in Switzerland but also ensures the implementation of the Austrian authorities' legitimate tax claims.

Both sides acknowledge that the agreed system will have a long-term impact that is equivalent to the automatic exchange of information in the area of capital income.

The agreement requires the approval of parliament in both countries, and should enter into force at the start of 2013.

¿Alguien sabe de las conexiones de la Banca Suiza (u otras) con los Rotary (o rotarios)?

Por lo poco que yo se, es una organización-logia que simplemente, acoge a gente con pasta. No tiene demasiada parafernalia y es un club de influencias extendido por medio mundo.  Apenas hay información acerca del tema, pero si es lo que parece ser, es simplemente una logia moralista de red de contactos.

Lo que pasa es que habiendo tenido a gente como Chamberlain, Hassan II, Thatcher o Sarkosy, uno no puede evitar preguntarse de que pie cojean...

En 1977,  el nuevo Consejo de Ministros, presidido por Adolfo Suárez, aprobó con toda  urgencia la reconstitución del Rotary Club Madrid, de modo que pudiera recibir  la Carta Constitucional en la Convención Internacional de Rotary International,  en San Francisco en mayo de 1977. Así, Jaime Enseñat, tras la aprobación  unánime de la fundación del Club, recibió en esta Convención la Carta Constitucional,  en presencia del Presidente de Rotary International. En la Convención desfiló  la Bandera Española y se interpretó la Marcha Real. De este modo, el RC-Madrid  (en esta nueva etapa, club no. 12616 de Rotary International) se convirtió en  el único Rotary club en el mundo, que ha recibido la Carta Constitucional en un  acto semejante.

         El Club se refundó con  los siguientes miembros:

 Jaime  Enseñat (Presidente), Jose Luis Perona (1er. Vice-Presidente), Nicolás Franco  (2do. ‘Caso Liechtenstein’...y ahora Suiza

Investigando bancos y clientes españoles que habían escondido dinero en Liechtenstein, Hacienda ha encontrado datos de otros que prefirieron llevarlo a Suiza.

Entre los investigados por tener cuentas allí están el presidente de Duro Felguera y Sebastián Enseñat, que fue asesor de Berlusconi y consejero de Tele 5.

En relación con la Operación Jade Limusina, la Cadena Ser adelantaba el nombre de Vontobel Bank

Las entidades que han podido canalizar estas inversiones son la sociedad financiera Merchban y el banco privado Vontobel Bank, un posible entramado de banca privada cuyo único fin era facilitar a los clientes la opacidad de su patrimonio.
